TERMS AND CONDITIONS

1. GENERAL TERMS

1.1. The online store operating under the following address https://grumpygeeks.eu/ (further called Store) belongs to Grumpy Geeks Jakub Firlit (further called Seller), doing business as Grumpy Geeks Jakub Firlit, Jakub Firlit, Osiedle Złotej Jesieni 13, 31-828 Kraków, Polska, NIP: 7381864361, REGON: 369611396  phone: +48 880979807, registered in the Central Registry of Business Activities (www.firma.gov.pl). 

1.2. The following Terms and Conditions define all rules regarding the purchase of goods in the Store, including but not limited to the rights and obligations of both parties, terms of service, payment methods, the rights of withdrawal etc.

1.3. By using the Store you (further called Buyer) agree to be bound by these Terms and Conditions. Buyers can freely view, download, archive and print these Terms and Conditions at any time. Terms and Conditions are also displayed (in the form of a link to this document) when placing the order.

1.4. Buyers may contact the Seller via the built-in messaging system, via e-mail (info@grumpygeeks) or via phone (+48 880979807). The orders however are placed only electronically at https://grumpygeeks.eu/ 7 days a week, 24 hours a day. 

1.5. The contract for the purchase of goods is made according to Polish law. 

1.6. The items and information shown in the Store do not constitute an offer in the meaning of the Polish Civil Code.

2. ONLINE SERVICES

2.1. Placing an order is possible via the built-in order form, as a Guest or upon registering as a User. The Seller provides the means of creating and maintaning a personal User account in the Store. 

2.2. Registration in the Store is free and can be done by filling up the form with Buyer's personal data (such as name, surname, e-mail address, phone number, shipping address, etc.). The Buyer can at any time and at no cost remove their User account and demand (via e-mail message) removal of all their personal data from the Store.

2.3. The built-in order form allows for the purchase of goods in the Store, according to section 3 of this document ('Terms of Sale'). 

2.4. In order to visit and use the Store, the Buyer needs to have a running Personal Computer (PC) or any such device connected to the Internet and able to run and display any of the supported web browser software: Google Chrome, Opera, Internet Explorer, Mozilla Firefox, Vivaldi. 

2.5. If you use this site, you are responsible for maintaining the confidentiality of your account and password (eg. by using an up-to-date antivirus software) and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. The Seller reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

2.6. The Seller grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of the Seller.

3. TERMS OF SALE

3.1. Orders can be placed electronically via the Store webpage located at https://grumpygeeks.eu/, available 7 days a week, 24 hours a day.

3.2. Placing an order is done by clicking on the chosen item, picking an appropriate size and clicking ‘Add to Cart’ then choosing the method of payment and confirming by clicking ‘Order and pay’. The Buyer can at any time choose to remove items from their cart or to refrain from placing an order.

3.3. Placing an order is equal to accepting all Terms and Conditions. Upon placing an order the Buyer will be asked to accept these Terms and Conditions.

3.4. After placing an order, the Buyer will receive a confirmation e-mail with the order number and a PDF file outlining all details of their order.

3.5. Placing and proccessing of all orders is done in Polish or English language.

3.6. When paying via credit or debit card, the order shall be processed after the payment has been registered.

4. PRICES AND PAYMENT

4.1. The prices displayed in the Store include tax and are expressed in one of the following currencies: Polish Złoty (PLN), Euro (EUR) or United States Dollars (USD). 

4.2. The prices displayed in the Store do not include a shipping fee. The shipping fee will be calculated and displayed in the Cart, upon choosing the preferred shipping method. 

4.3. All prices displayed in the Store are binding at the time of placing an order.

4.4. Available payment methods will be displayed in the Cart. Payment methods may differ depending on the Buyer's country of origin. 

4.5. The online payment support is provided by Blue Media S.A.

4.6. Available means of online payment:

4.7. The PDF file attached within the confirmation e-mail acts as a proof of purchase. Additionally, all orders are accompanied by a printed receipt.

5. SHIPPING

5.1. All our products are hand-printed by us and are shipped from Poland, EU. 

5.2. The shipping fee depends on several factors (such as: target country, total weight of the package, shipping method, etc.) and will be calculated and displayed in the Cart, upon choosing the preferred shipping method. 

5.3. The orders are shipped to the shipping address provided by the Buyer.

5.4. The orders are shipped via our shipping partners. 

5.5. Orders are generally dispatched within 1-3 business days after the receipt of payment. Delivery times vary depending on the target country, but should take no longer that 15 business days. 

5.6. By purchasing a product you authorize us to conclude a contract in your name for delivery of the purchased goods. This basically means that the shipping fee will be handed over to the postal service and will be used solely for the shipping of your order. At the same time you retain the right to return the item to us within two weeks from the moment you actually receive the item from the delivery service.

5.5. When, during delivery, the packaging is showing signs of damage or any interference with its contents, the Buyer may refuse to accept the package and prepare a protocol of damages that should be attached to the package and returned to the Seller.

6. PRODUCT QUALITY

6.1. The Seller will use their best efforts to provide a product free of any damage and at the highest possible quality. If, however, the Buyer receives a faulty product they have the right of complaint. 

6.2. Complaints should be sent via e-mail to info@grumpygeeks.eu or to the following address: Jakub Firlit, Osiedle Złotej Jesieni 13, 31-828 Kraków.

6.3. Complaints shall be reviewed within 14 days following the date of notification. 

7. RIGHT OF WITHDRAWAL

7.1. The Buyer retains the right to withdraw from the contract within 14 days without giving any reason. 

7.2. The withdrawal period will expire after 14 days from the day on which the Buyer acquires physical possession of the item sold in the Store.

7.3. In order to exersize the right of withdrawal, the Buyer must inform the Seller of their decision to withdraw from this contract via physical letter or an e-mail (info@grumpygeeks.eu).

7.4. The Buyer may use the withdrawal form attached below, but it is not obligatory.

7.5. If the Buyer withdraws from this contract, the Seller shall reimburse to the Buyer all payments received, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day the Seller was informed about the decision to withdraw. The Seller will carry out such reimbursement using the same means of payment as used for the initial transaction. In any event, the Seller will not incur any fees as a result of such reimbursement.

7.6. The Buyer shall send back the goods without undue delay and in any event not later than 14 days from the day on which the Buyer informed the Seller about their withdrawal. The Buyer shall bear the direct costs of returning the goods.

7.7. The Seller may withhold reimbursement until they receive the goods back or the Buyer has supplied evidence of having sent back the goods, whichever is the earliest.

7.8. The Buyer is responisble for packing up the returned goods in such a way as to minimize the risk of damage during transport, at the level similar to the original packaging. 

8. PRIVACY POLICY

8.1. When using the Store, the Buyer will be asked to input personal details such as name, e-mail address, billing address, delivery address, credit card or other payment information. The Seller named in p 1.1. of this terms sheet operates as the Data Administrator for all personal data provided by Buyers.

8.2. The Seller confirms that this information will be held and processed in accordance with the registration done with the Data Commissioner's office and the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). 

8.3. The Store employs industry-standard SSL to provide secure communication (including for credit card transactions). SSL is a communications protocol for transmitting private information over the internet. It works by encrypting data that is transmitted over the SSL connection.

8.4. In addition to the company's safeguards, the Buyer's personal data is protected according to the regulations of the Data Protection Act (Personal Data Protection Act from 29th August 1997). The Data Protection Act requires us, as registered Data Controllers, amongst other things to ensure that the data we hold about you should be processed lawfully and fairly.

8.5. The Seller will only use the stored personal data for the purpose of communicating with the Buyer as well as processing and shipping the order. The Buyer may at any point ask the Seller to make available, change or remove parts or all of their stored personal data. 

8.6. The personal data may be passed to other parties but only for the purpose of completing your order - eg. It support, payment services or delivery services. We will never release or use your personal data for any purposes other than messaging you and completing your order.

9. ONLINE DISPUTE RESOLUTION

9.1. If the Buyer has any problems or complaints with goods or services provided by the Store they have an option to resolve their issues without going to court, mainly by contacting their local Trade Inspectorate. 

9.2. If the Buyer has any problems or complaints with goods or services provided by the Store they can use the EU Online Dispute Resolution platform in order to resolve their customer issues without going to court.

9.3. The Online Dispute Resolution platform is available under the following address: https://ec.europa.eu/consumers/odr - the ODR platform is a multi-lingual, mediational hub for settling disputes out of court across the European Union. 

10. COPYRIGHT

10.1. All items and item descriptions, artwork, designs and photographs presented within the Store are protected by the Intellectual Property Law. Therefore it is prohibited to copy and distribute any content of this Store in any manner without the consent of the Seller.

10.2. It is prohibited to frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Seller or any of its associates without express written consent.

11. FINAL PROVISIONS

11.1. All matters and cases not covered by this document shall be governed by the laws of Poland (mainl Polish Civil Law, Polish Commercial Laws as well as Copyright Laws) and to the extent applicable - the laws of European Union.
